NEPA Indicators as an Agency's Scorecard

Often, a resource specialist declares that impacts will occur but finds it difficult to measure these impacts quantitatively. Doyon, Limited, an Alaska Native Claims Settlement Act (ANCSA) Corporation, currently owns 1.25 million acres within the exterior boundary of Yukon Flats NWR. Negotiators for Doyon and the U.S. Fish and Wildlife Service, Alaska Region, have agreed in principle to provide Doyon title to some refuge lands that may hold developable oil and gas resources. In exchange, the Service will receive habitat currently owned by Doyon within the refuge boundary. This will consist of wetlands previously identified by the Service as quality fish and wildlife habitat. click to view 

 

NEPA Tip of the Month

WHAT HAPPENS IF NEPA OR OTHER ENVIRONMENTAL LAWS ARE VIOLATED

  1. Public scrutiny is the primary watchdog for NEPA non-compliance.
  2. Penalties for NEPA non-compliance involve court-imposed injunctions and sanctions.
  3. NEPA has no statute of limitations for violations.
  4. Substantive environmental laws usually have regulatory agencies with authority to enforce compliance.
  5. Penalties for substantive laws involve injunctions and often civil and criminal penalties.
