NEPA's Ambiguous Purpose and Need ”

Writing an accurate and useful Chapter 1: Purpose and Need has been and continues to be a challenge. For over 25 years National Environmental Policy Act (NEPA) practitioners have wrestled with the role of this ambiguous chapter. The resulting versions of Chapter 1 have often been too vague to be useful or obviously biased justifications of the proposed action.

"The Minerals Management Service (MMS) today published a Federal Register notice announcing plans to prepare an Environmental Impact Statement (EIS) for the proposed Cape Wind Energy Project in Nantucket Sound, Massachusetts. The notice also asks for public input via written comments and invites interested agencies to participate in the preparation of the EIS as it moves through the official approval process.”

”Chairman Richard W. Pombo introduced the American Fisheries Management and Marine Life Improvement Act.  This bill reauthorizes the Magnuson-Stevens Act, which is the paramount law governing American Fisheries and Fishing related activities in U.S. waters.”

Reviewing NEPA Documents (RND) -
Reviewing for Document Quality and Readabilty

Document Quality and the accompanying readability of a document arise from features and techniques that appear in the following three levels:

Level 1- Content, Format and Organization

  1. Does the document format (page layout) aid readers to navigate from chapter to chapter and section to section?
     
  2. Do readers know when they begin the document, a chapter, or a subsection what they are going to read and why?
     
  3. Are legal, regulatory, and policy implications clearly stated?
     
  4. Are sections and subsections clearly and logically linked, usually through headings, subheadings, and deliberate repetition of key information?
     
  5. Do conclusions and recommendations appear at the beginnings of sections, subsections, paragraphs, and sentences?
     
  6. Are graphics (tables, figures, charts, graphs, illustrations, and maps) used effectively to convey information?
